Acceptance
  • By placing order for goods through our online shopping, the Customer is deemed to accept the terms and conditions of sale.
  • On purchase of any goods from OC Zone a tax invoice is issued which details the order as OC Zone has received it. In case the Customer find any discrepancies please notify OC Zone in writing within seven days. An order is accepted subject to the prices in effect at the time of shipment and to the conditions thereof.


Price
  • Unless otherwise stated, all prices exclude GST, freight charge, insurance, and handing cost. These charges will be added onto the quoted prices.
  • OC Zone reserves the right to revise prices at any time prior to accepting an order. Receipt of an order by OC Zone from the Customer does not constitute acceptance by OC Zone.
  • Prices are subject to change without prior notice.
  • The prices quoted may be revised by OC Zone subsequent to accepting an order in the event of any occurrence affecting delivery caused by War, Government action, variation in Customs duties, increased shipping charges, and any other matter beyond the control of OC Zone. In that event the Customer shall have the right to withdraw the order.


Payment

  • All payments must be transferred into OC Zone's bank account prior to the release of any products. The payment forms that are currently accepted include Cash and EFTPOS at the Super Services; Direct deposit
  • Customer shall not be entitled to withhold payment or to make any deductions from the contract price without the prior written consent of OC Zone.
  • All overdue accounts shall bear interest at the rate of 2.5% per month chargeable on a daily basis from the due date for payment until the time of actual payment but without prejudice to OC Zone other rights and remedies in respect of Customers default in failing to make full payment on the due date.
  • The Customer will upon demand pay to OC Zone all money (including but not limited to solicitors costs, Court costs and disbursements) incurred or expended by OC Zone in recovering payment of any overdue account.
  • Receipt of cheque, bill of exchange, or other negotiable instrument by OC Zone shall not constitute payment and the Customer shall remain liable for the full invoice price until such cheque, bill of exchange, or negotiable instrument is paid in full. Until such indebtedness has been discharged the Customer shall store the goods in such a way that they can readily be identified as the property of OC Zone.

Delivery

  • Once the payment is received, OC Zone will take all reasonable steps to ensure the delivery of goods or performance of services is prompt, but shall not be responsible for any loss whatsoever sustained by the Customer for delay in delivery.
  • If the Customer cannot physically come for pick-up, courier will be arranged through either Fastway Courier or Post Haste. Please note that OC Zone has no control over the courier companies' delivery time. And no claim shall be made on account of late shipment or delivery how ever it is caused.
  • Goods will be sent to the address that provided by the Customer at the time of placing the order. If wrong address or insufficient address is submitted, or a change of address is requested after the products are released, then it is the Customer's responsibility to get the product from the address firstly provided. OC Zone will try to alert and request the courier company to redirect it to the new address and if they are unable to do it, then the Customer is liable for the loss of the package.
  • OC Zone reserves the right to deliver the goods by instalments and each instalment shall be deemed to be a separate contract under the same provisions as the main contract. Should OC Zone fail to deliver or make effective delivery of one or more instalments this shall not entitle the Customer to repudiate the main contract.
  • Estimated delivery time shown underneath are indicative only:
    • Auckland region: one working day
    • Short-haul: over night
    • North island: two to three working days
    • South island: three to five working days
  • Packaging and delivery charges per items:
    • Auckland local: First item $4.99 +GST. Each additional item add 3.99+GST
    • Short-hore: First item $7.99 +GST. Each additional item add 6.99+GST
    • North island: First item $10.99 +GST. Each additional item add 9.99+GST
    • South island: First item $14.99 +GST. Each additional item add 13.99+GST
    • Overnight: First item $25.99 +GST. Each additional item add 23.99+GST


Cancellation and return

  • In the event that the Customer cancels any orders subsequent to despatch by OC Zone to the Customer (regardless of whether or not said order has been delivered to the customer), OC Zone will credit the Customer for the order value less 20% of restock fee on return in saleable condition of the items ordered provided such return is within 7 days of despatch. Freight charges will not be credited.
  • Unless agreed in writing by the issuance of a Goods Return Authority from OC Zone no goods will be accepted for credit after despatch. No goods will be accepted for credit if the goods are found to be tampered with or damaged or disk seals are broken.
  • The Customer shall be liable for all delivery and insurance charges incurred in respect of returned goods.
  • OC Zone reserves the right to cancel this agreement or an order (without prejudice to any of its rights) immediately upon any of the events:
    • If the Customer cease or threaten to cease to carry on business; or
    • If a receiver or similar officer is appointed in respect of all or any assets belonging to the Customer, or the Customer is unable to pay its debts when they fall due, enter into a scheme with its creditors or any steps are taken to place the Customer into liquidation; or
    • If the Customer commit a breach of this agreement and the breach is not remedied within 14 days of notification of the breach by OC Zone.
  • Upon termination OC Zone shall be entitled repossess and resell any unpaid goods within the term of terms risk and ownership. Termination shall not relieve the Customer from any liability or responsibility that has arisen before the date of termination.

Risk and ownership

  • The pictures listed on our website might differ from actual products.
  • Risk of any loss, damage or deterioration of or to the goods passes to the Customer at the point of delivery from OC Zone's warehouse.
  • Ownership of the goods remains with OC Zone and does not pass to the Customer until the Customer pay all amounts owing to OC Zone or resell the goods in accordance with these terms.
  • While ownership of the goods remains with OC Zone:
    • The Customer must store them separately or clearly identify them as belonging to OC Zone.
    • OC Zone authorise the customer in the ordinary course of the customer's business to use the goods or sell them for full consideration. This authority is revoked from the earlier of the following:
      1. OC Zone deem the Customer the credit to be unsatisfactory;
      2. the occurrence of an Event of Default; or
      3. the time that OC Zone notify the Customer in writing that this authority is revoked
    • OC Zone can enter the premises where the goods are stored and remove them without being responsible for any damage caused in doing so. OC Zone can resell any of the goods and apply the proceeds of sale in reduction of amounts the Customer owed to OC Zone.
    • If the Customer resell or use the goods before ownership of the goods has passed, the proceeds of such sale or use shall be received and held by the Customer (in whatever form) in trust for both the Customer and OC Zone. OC Zone's interest as beneficiary under that trust shall be that portion of the proceeds which does not exceed all amounts that the Customer owes OC Zone. The Customer will be entitled to the balance of the proceeds.
    • OC Zone can bring an action for the price of the goods sold even where ownership of the goods may not have passed to the Customer.


Warranty

  • Warranty is for hardware only, not for software or configuration.
  • Please download the RMA Form from OC Zone's website, and fill it in carefully. The completed RMA Form of purchase must be presented for warranty.
  • Unless stated otherwise, the warranty term is "return to base", and the Customer is responsible to return the system or defective component, properly packaged to OC Zone for repair or replacement. If it is not properly packaged, the Customer is responsible for any damage it might cause to the product.
  • The tax invoice or other proof of purchase must be presented for warranty.
  • The repair work would be accomplished in a timely manner and subject to the availability of the parts (repair or replacement). Sometimes a repair may take longer than the usual time due to circumstances beyond OC Zone's control. OC Zone shall not be liable for delay or failure to perform its obligations if the cause of the delay or failure is beyond its control.
  • If the problem found is user inducement then it is not covered under warranty. Ex: Virus, shareware/demo software or deletion of system files generating system errors or crashes.
  • In case there is no fault or if the fault is user inducement then there will be a fee of $ 45 + GST charged before the system is returned. If any of the parts supplied by OC Zone is defective then OC Zone will fulfill its responsibility during the warranty period. But if the Customer is unable to install or configure it properly or if it is incompatible with other components, then it is not covered under warranty and there will be a fee of $45 + GST.

Please Note: If there is no faulty with the product which customer sent back for warranty, the shipping fee for return the good back will be paid by the customer and the additional serve fee might be charged base on the time speed with testing the parts.


Consumer Guarantees Act

  • If goods acquired by the Customer are for business purposes, then the Customer agrees that the Consumer Guarantees Act 1993 does not apply.
  • If the Customer on supply goods then the Customer must
    • Do so on the basis that the Act does not apply where the goods are on supplied for business purposes; and
    • Notify their consumers that neither OC Zone nor any manufacturers undertake that repair facilities or spare parts will be available
    • Acknowledge that no Express Guarantees as defined in the Act are provided
    • If a claim is made directly against OC Zone by a consumer of the Customer under the Act then the Customer will refund to OC Zone the amount of any damages (up to the value of the Customer's margin made on the goods in question). OC Zone is required to pay to that consumer under the Act.
    • Nothing in these terms is intended to have the effect of contracting out of the provision of the A ct except to the extent permitted by the Act
  • Except as otherwise required or prevented by law or except as expreOC Zoney provided under these terms, OC Zone is not liable for any claim in relation to any goods that supply to the Customer (including as a result of negligence or otherwise) and all representations, guarantees, warranties and terms of whatever nature (including fitness for purpose) are completely excluded.

Sellers Liability

  • OC Zone shall not be liable for any delays or failure in complying with any obligation imposed on it under any contract or for any loss or damage (including indirect or consequential loss of profits, data or damage) as claimed by the Customer.
  • Should any liability in relation to this agreement (or the goods supplied under this agreement) be imposed on Unisys for any reason, OC Zone's total liability to the Customer is limited to the price of those goods and services supplied by OC Zone to which the liability relates. OC Zone will not, in any case, be liable for any consequential or special damages, including loss of business profits.
  • If OC Zone is unable to provide its obligation under the terms of this agreement by reason of strike, lock-out, riot, industrial action, fire, storm, operation of law or other cause beyond its control, then OC Zone is released from the obligation under this agreement.
  • Claims on incorrect delivery, quality, loss of, and damages to any materials must be made within 72 hours after receipt of the goods or after the due delivery date in the event of a non delivery. All claims after that period will not be accepted. Any returns are subject to a restocking fee.

Governing Law

  • The contract and its terms are governed by, and shall be construed in accordance with, the laws of New Zealand. Both parties submit to the exclusive jurisdiction of the courts of New Zealand.
